THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT IN THE NATURE OF CERTIORARI BY QUASHING THE IMPUGNED ORDER DATED 05.02.2020 BEARING NO.SUP.3/C.VA.NYA.PA/CR.27/2019-20 VIDE ANNEXURE-E PASSED BY THE RESPONDENT NO.2; ISSUE A WRIT IN THE NATURE OF MANDAMUS/DIRECTION TO THE RESPONDENTS TO CONSIDER THE GRIEVANCE OF THE PETITIONER UNTIL THE LICENCE IS NOT RENEWED.

A person by name Sri. B.C.Hiremath was running a fair price shop at Hangarki Village. The same got closed. As a temporary measure, the card holders of the closed fair price shop were assigned in favour of the petitioner though he was only granted permission to distribute kerosene and not other commodities in a fair price shop. This arrangement was made in the year 2003 and the same continued till 2020. The government after realizing that it was only a temporary arrangement, by way of impugned order, assigned the ration card holders in favour of the 6^th respondent. Aggrieved by the same, the present writ petition is filed.

Learned AGA upon instructions submits that the

arrangement as per the impugned order in assigning the ration card holders in favour of the 6^th respondent is also a temporary arrangement and within one month from the date of receipt of certified copy of this order, the State authorities would take steps to invite fresh applications for

a fair price shop at Hangarki Village, wherein the petitioner can participate, if he has the necessary qualification and prays that the writ petition may be disposed off accordingly.

Petitioner has no objection for the same.

Hence, the writ petition is disposed off in terms

of the submission made by the learned AGA.
