MFA FILED U/S 173(1) OF MV ACT AGAINST THE JUDGMENT AND AWARD DATED 08.07.2020 PASSED IN MVC NO. 131/2014 ON THE FILE OF THE PRINCIPAL SENIOR CIVIL JUDGE AND MACT, MADHUGIRI, PARTLY ALLOWING THE CLAIM PETITION FOR COMPENSATION AND SEEKING ENHANCEMENT OF COMPENSATION.

THIS APPEAL COMING ON FOR CONCILIATION BEFORE LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED.

CONCILIATION ORDER

The appellant – claimant and respondent No.1 – owner and their respective learned Counsel are present.

The learned Counsel appearing for both appellant and owner have filed

a joint memo with their signature and their respective Advocates stating that the matter is settled in the Lok Adalat. Conciliation is held. Accordingly, both the appellant – claimant and respondent – owner have agreed to settle the

matter for a sum of Rs.40,000/- (Rupees Forty Thousand only). It is agreed that the owner of the offending vehicle shall pay compensation to the claimant by way of Demand Draft bearing No.432986 dated 22.06.2023 drawn on Union Bank of India and accordingly, the owner has issued the said Demand Draft to the claimant and the claimant has acknowledged the receipt of the said Demand Draft as full and final settlement towards the dispute. In respect of the demand draft, both the claimant and the owner of the vehicle have affixed their signature on the Order Sheet along with their Advocates.

Accordingly, this Miscellaneous First Appeal stands disposed of in terms of the Joint memo. The Judgment and Award of the Tribunal shall stand modified accordingly. Draw up the Award accordingly.
