the information furnished by the complainant before the respondent No.1, indicates the instances of alleged adulterous life lead by the accused No.2 with the accused N0o.1. The Trial Court has discharged the accused No.1 of the offence punishable under Section 497 of IPC and has proceeded to frame charge against the accused for the other offences. Having regard to the nature of allegations made by the complainant, it is difficult to accept that there was any justification to prosecute the accused for the offences punishable under Sections 416, 417, 418, 419, 420, 109 of IPC. A reading of the entire charge-sheet and the materials placed along with it, does not show the involvement of any property or its entrustment, to constitute an offence of cheating.
