named prays that this Hon'ble Court may be pleased to issue writ or order of Mandamus directing the Respondent to refund whole of the Betterment Charges of Rs.4,80,733/- and Development Charges of Rs.5,38,544/- all aggregating to Rs.10,19,277/- collected by them from the petitioner under Annexure-D and Annexure-F without authority of law and jurisdiction and contrary to Article 265 of Constitution of India and further prays that the Respondent may be directed to pay interest at the rate of 12% p.a. on such illegal levy from the date of deposit till the return of the said amount to the petitioner and further prays that the respondent may be restrained from collecting Betterment Charges and Development Charges from the petitioner, living under the territorial jurisdiction of BBMP, for transferring the Khatha in his name, as per condition for transfer of such Khatha and prays for such other reliefs as this Hon'ble Court deem fit to grant, in the facts and circumstances of the case, including costs in the interest of justice and equity."
