THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE RESPONDENT TO ENSURE AND MONITOR THE PACKAGED DRINKING WATER LICENSEES, SO THAT THEY SHOULD MANUFACTURE/OPERATE IN CONFORMITY TO LAW CONTEMPLATED UNDER BIS ACT, RULES AND REGULATIONS AND ETC.,

THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP , THIS DAY, THE COURT MADE THE FOLLOWING:

O R D E R

The petitioner has filed this writ petition seeking the

following reliefs:

"a) Issue a writ in the nature of Mandamus directing the respondent to ensure and monitor the packaged drinking water licensees, so that they should manufacture/operate in conformity to the law contemplated under BIS Act, Rules and Regulations.

b) Issue a writ in the nature of Mandamus directing respondent to take immediate action by cancelling the license of 54 units enclosed along with the representation dated 8.1.2016 vide Annexure-D as per the regulations as per the law contemplated under Section 15 of the BIS Act 1986.

c) Issue a writ in the nature of Mandamus directing the respondent to take immediate action as against 8 units whose license have been assessed unsatisfactory as submitted in the letter dated 1.2.2016 vide AnnexureE issued by the BIS;

d) Issue a writ in the nature of Mandamus directing the respondent to supply all the information with respect to all 54 units as sought by my client through RTI application 26.2.2016 vide Annexure-F.

e) Issue such other order or direction, as this Hon'ble Court may be deemed fit and appropriate, in the circumstances of the case, in the interest of justice and equity."

It is stated by the learned counsel for the petitioner as well as the respondent that subsequent to filing of this writ petition, the petitioner has filed W.P.No.42811/2018 in public interest, seeking almost similar prayers that are sought for in the present writ petition.

In that view of the matter, this writ petition is

disposed of reserving liberty to the petitioner to urge all contentions.
