THIS WRIT PETITION IS FILED UNDER ARTICLE 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE RESPONDENTS TO REGISTER THE INDUSTRIAL PLOT NO.242 OF THANDYA 2ND STAGE, INDUSTRIAL AREA, NANJANAGUD TALUK, MYSURU DISTRICT AND HANDOVER THE POSSESSION OF THE PLOT FORTH WITH AS PER ANNX-A TO THE WRIT PETITION.

This petition is filed with a prayer seeking a direction against the KIADB to allot industrial plot No.242 in Thandya 2^nd Stage, Industrial Area, Nanjanagud.

Learned Advocate for the petitioner submitted that an Industrial Plot was allotted by the Single Window Agency and in pursuance thereof, he has paid a sum of Rs.1,61,980/- to the KIADB. Therefore, direction may be issued to KIADB for allotment of the aforesaid mentioned Industrial Plot.

Sri.Monesh Kumar, learned Advocate for respondents No.3 and 4 submitted that a Single Window

Agency approves the project. However, allotment of land is made pursuant to the online application filed with the KIADB. Such application will be considered according to the seniority and as per the regulations. The amount said to have been paid by the petitioner is without reference to any application.

Learned Advocate for the petitioner submitted that the petitioner would be satisfied if a direction is issued to the KIADB to consider the online application filed on 24.06.2021 by the KIADB.

In view of the above, this petition is disposed of with a direction to the KIADB to consider petitioner’s application as per their regulations in its priority.

Placing the submissions made by learned Advocate for the parties, this petition is disposed of.

In view of disposal of the petition, I.A.No1/2021 does not survive for consideration and the same stands disposed of.
