In their reply dated 30.04.2016, petitioners contended that fourth respondent having initiated proceedings before the Deputy Registrar of Chits, it should proceed under Chit Funds Act, 1882 and not under the Negotiable Instruments Act.

9. Admittedly, the cheques issued by the petitioners
have been dishonoured. This Court under Article 226 of the Constitution cannot hold a roving enquiry into the facts of the case. Therefore, the writ petition is liable to be dismissed.
