This Regular Second Appeal is filed under Section 100 of the Code of Civil Procedure against the judgment and decree dated 13.01.2011 passed in Regular Appeal No.47 of 2009 on the file of the Presiding Officer, Fast Track Court, Devanahalli, dismissing the appeal confirming the judgment and decree dated 06.11.2009 in OS No.4 of 1998 on the file of the Principal Civil Judge (Jr. Dn.) and JMFC, Devanahalli.
This Appeal coming on for Admission, this day, the court delivered the following:
J U D G M E N T
This Court, on 08th July, 2021 passed the following order:
“ If the matter is not prosecuted on the next date of haring, it shall stand disposed of as per law. List on 30th July, 2021. ”
The appeal was taken up in the morning session and
there was no representation on behalf of the appellants and thereafter the matter was passed over and taken up at 3.25 p.m. Even on the second occasion, there is no representation on behalf of the appellants. In that view of the matter, in view of the order passed by this Court referred to above, appeal is dismissed for non-prosecution.
