ORDER
This petition is disposed off as withdrawn in terms of
the Memo dated 07.12.2021 filed by the petitioner, which reads as under:
"1) The Petitioner has filed this instant Petition seeking appointment of an Arbitrator for a dispute arising out of an Agreement entered into between the Petitioner and the Respondent. The Respondent subsequently issued a Legal Notice seeking to dispossess the Petitioner from the premises under use and occupation by the Petitioner.
2) The Petitioner has since vacated the Petition Schedule premises and handed over the same to the Respondent. This instant matter has therefore become infructuous.

WHEREFORE, it is humble prayed that this Hon'ble Court be pleased to permit the Petitioner to withdraw this instant Petition as not pressed, in the interests of justice and equity failing which great loss and suffering will be caused to the Petitioner."
