Heard the learned counsel for the petitioners and the respondents.

Learned counsel for respondent No.2 has filed a memo stating that the writ petition has become infructuous and does not survive for consideration.

Memo is taken on record. The contents of the memo reads as under:

“1. The above petition is filed praying for quashing the letter of rejection dated 15.05.2012 at Annexure-D issued by this Respondent and seeking direction to this Respondent to consider the representation dated 14.07.2012 at Annexure-W seeking permission to start new Engineering College for the academic year 2012-13.

2. The Petitioner, after filing above Writ Petition, has filed application for starting new engineering college for the academic year 2013-14 and approval was accorded by this Respondent for the academic year 2013-14.

3. Since the Petitioner has sought for quashing rejection of approval for the academic year 2012-13, the above petition not survive for consideration and hence infructuous.”

Learned counsel for the petitioners also submits that the petition has become infructuous. Accordingly, writ petition is dismissed as having become infructuous.
