1. The present writ petition has been filed for the following reliefs :-

“ (a) for appropriate writ/ writs, order/ orders, direction/ directions particularly a writ in nature of mandamus for not acquiring the land of the petitioner and others over plot no.1146 of Khata no.1 as for acquisition of the said land more than 100 of trees will have to be cut for construction of road, if the road is diverted hardly for 100 feet in that case vacant land is available which can be used for construction of road as over the plot of the petitioner several grown-up trees are present and the same is within boundary wall of the petitioner, the trees are being planted, for saving the environment and if the land of the petitioner and others is acquired the same will cause environmental hazards to the people residing in the area, as per the report of the Anchal

Amin 25 huge trees will have to be cut.

(b) for appropriate writ/ writs, order/ orders, direction/ directions particularly a writ in nature of mandamus for grant of adequate compensation to the petitioner if the land of the petitioner is acquired for construction of road as the land of the petitioner and the plot over which the petitioner's land is situated is not a forest land as held by competent court of the learned District Judge-VI, Chatra in Civil Appeal No. 10/2020 wherein the learned court has held that the plot no. 1146 area recorded as Gair Majurua Khas land is not a forest land as per the finding of the learned court in paragraph no.18 of the judgment, respondent authorities has not consider this fact and has declined to pay compensation to the petitioner.”

2. After some arguments, learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to avail the alternative remedy which is available under the Land Acquisition Act and other laws.

3. Learned counsel for the State has no objection.

¶21

4. Accordingly, the present writ petition is, hereby, disposed of with the aforesaid liberty.

5. Pending interlocutory application, if any, stands disposed of.
