1. The present writ petition has been filed for following reliefs:-

“for issuance of appropriate writ/writs, order/orders, direction/directions in the nature of certiorari for quashing of the notice dated 15/2/2021 (Annexure-7) issued by the Circle Officer, Chainpur (Respondent no.3) by which the petitioner has been directed to appear in the court of the respondent no.3 with the documents appertaining to land Chainpur Thana No. 114, Khata No.20, plot No. 1352 area 0.36 acres, so that the said encroached land could be vacated.

And the petitioner further prays for issuance of appropriate writ/writs, order/orders, direction/directions calling upon the respondents to show cause as to how and under what circumstances and which authority the respondent no.3 has issued the impugned notice upon the petitioner for vacating the raiyati land of the petitioner.

The petitioner further prays for direction upon the respondent no.3 not to interfere in peaceful possession of the petitioner over the land Chainpur Thana No.114, Khata No.20, plot No. 1352 area 0.36 acres.”

3. It is admitted position that it is a private dispute between the two private raiyats but that has been sought to be resolved by using the executive power of a Minister which is otherwise not permissible. The law of a land has to be prevailed not desire of a Minister or any authority.

6. In view of above discussion, the impugned notice (Annexure-7) is not acceptable in our legal system, accordingly, it is hereby quashed and set aside.

7. However, the parties are at liberty to work out their remedies in accordance with law.
