13/ 02.02.2026 The instant writ application has been preferred for considering the petitioner’s representation for ACP benefit as he has completed 25 years of service.

2. In this regard it is observed that the issue of ACP/MACP benefit has already been set at rest by the Hon’ble Apex Court in the case of Amresh Kr. Singh & Ors. v. State of Bihar & Ors. , reported in (2023) SCC Online SC 496 ; as such, the instant application is hereby disposed of by giving liberty to the petitioner to file fresh representation before the concerned respondent within a period six weeks from today. The moment the concerned respondent will receive any such representation(s), he shall take decision in accordance with law and applicable rules and regulations as well as the law laid down by the Hon’ble Apex Court in the case of Amresh Kr. Singh & Ors. (supra) within a period of 12 weeks from the date of receipt of such representation.

3. It goes without saying that if the decision is taken in favour of the petitioner, the consequential benefits shall be extended to him within a further period of 4 weeks.

4. With the aforesaid observations and directions, the writ petition stands disposed of.
