The instant writ application has been preferred by the petitioner, praying for quashing and setting aside the order dated 16.09.2021 (Annexure-1) passed by the learned Recovery Officer, Debt Recovery Tribunal, Ranchi in R.P. No.121/2002 to the extent that he has decided to put on auction the land, building and shed standing on Khata No.01/07 of Mouza Lundri, Thana No.56 Plot NO.1447 measuring a total area of 251 decimal.

2. After some argument, learned counsel for the petitioner submits that the instant application may be disposed of by giving liberty to the petitioner to raise his grievance before the concerned trial court where the Title Suit No.232 of 2004 is pending.

3. There is no objection from the respondent-

4. Having regard to the aforesaid facts and circumstance of the case, the instant writ application is hereby disposed of with a liberty to the petitioner to raise his grievance before the trial court in the pending title suit.

5. With the aforesaid observation and direction, the instant writ application stands disposed of. Pending I.A.s if any, also closed. Interim stay, if any, is also vacated.
