In spite of valid service of notice, the opposite party did not appear in the present case.

Heard learned counsel for the petitioner.

Instant transfer petition has been preferred for transfer of Original Suit No. 806 of 2025 from the Court of learned Principal Judge, Family Court, Ranchi to the Court of learned Principal Judge, Family Court, Latehar.

Learned counsel for the petitioner has submitted that marriage of the petitioner with opposite party was solemnized on 18.10.2018. After marriage, the petitioner lived with the opposite party at her matrimonial house. They have one female child named Aiasha Siddika about 6 years. The petitioner claims that she was not treated with respect by her husband and in-laws and they allegedly abused, humiliated and assaulted her over small matters. The petitioner submits that she is a helpless woman living with her aged and infirm parents and has no sufficient means or assistance to attend court proceedings in Ranchi. She fears that if she goes to Ranchi, the opposite party may file false cases against her

or cause harm to her. It is also submitted that the opposite party is involved with another woman and because of this, he assaulted her and forced her out of the matrimonial house without reason. It has also been submitted that the petitioner is residing at her parental house and it is very difficult for her to attend court proceedings in Ranchi, as her father is old and ill and she has no sufficient means. The distance between Latehar and Ranchi is about 100 Km. which makes travel difficult for her. Hence, the petitioner prays for transfer Original Suit No. 806 of 2025 from the Court of learned Principal Judge, Family Court, Ranchi to the Court of learned Principal Judge, Family Court, Latehar.

Considering the contentions raised on behalf of the petitioner, I feel inclined, in the ends of justice, to allow the prayer of the petitioner.

Accordingly, Original Suit No. 806 of 2025, which is pending before the Court of learned Principal Judge, Family Court, Ranchi, is hereby transferred to the Court of learned Principal Judge, Family Court, Latehar.

Accordingly, the present transfer petition is allowed.
