The petitioner is apprehending his arrest in connection with Pratappur P.S Case no. 85/2025 registered under sections 274,275,3(5), of BNS and Section 47(A) of Excise Act, pending in the court of learned S.D.J.M Chatra.

Learned counsel appearing for the petitioner submits that the petitioner happened to be the owner of Scorpio and she is a housewife. He also submits that the allegations are made of carrying the foreign liquor in the said Scorpio and the driver has escaped from the spot. She also submits that the petitioner has got no criminal antecedents as disclosed in Para 13 of the petition.

Learned counsel appearing for the State opposed the prayer and submits that the petitioner is the owner of the Scorpio and the allegations are there of recovery of foreign liquor.

In view of the above and considering that the petitioner happened to be the owner and it has been pointed out that she is a housewife and she has got no criminal antecedents and in the FIR the

allegations are there against the driver, who has fled away from the spot, the petitioner has got no criminal antecedent and the petitioner is not named in the FIR, in that view of the matter, the petitioner above named is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and condition and sureties, the learned Court may deem fit and proper.
