02/ 16.02.2026 : Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Jama P.S. No. 47 of 2025, registered under sections 191(2), 190, 115, 118(1), 352, 324 (2), 303(2), 109 of BNS, pending in the Court of learned J.M. Ist Class, Dumka.

Learned counsel for the petitioners submits that due to property dispute false case has been lodged against the petitioners. He next submits that late Hiralal Mandal has executed WILL in favour of Basant Kumar Mandal @ Basant Mandal and entire property was let out to Basant Kumar Mandal @ Basant Mandal for that false allegation has been made and entire family members have been falsely implicated in this case. According to him injury has been found to be simple. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that in the order of learned Sessions Judge injury has been commutated fracture of anterior wall and middle wall of left maxillary sinus and another

fracture of left frontal bone and left nosal bone and the overall injuries found grievous in nature caused by hard blunt substant.

Looking into contents of F.I.R, it transpires that allegations of assault are there against Ashok Kumar Mandal @ Ashok Mandal.

Considering that there is direct allegation of assault against the petitioner no.1 namely, Ashok Kumar Mandal @ Ashok Mandal, I am not inclined to grant anticipatory bail to the petitioner no. 1. Accordingly, his prayer for bail is hereby rejected.

So far anticipatory bail on behalf of petitioner nos. 2 and 3 are concerned, there are general and omnibus allegations against them and WILL is in favour of petitioner no. 2 Basant Kumar Mandal @ Basant Mandal, I am inclined to grant anticipatory bail to the petitioner nos. 2 and 3. Accordingly, the above named, petitioner nos. 2 and 3 are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioner nos. 2 and 3 shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned J.M. Ist Class, Dumka, in connection with Jama P.S. No. 47 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
