The petitioner is apprehending his arrest in connection with Sector-4 P.S Case No. 83 of 2025 for the offences registered under sections-115, 126 (2), 117, 109, 352, 351(2), 351 (3), 303 (2) read with 3(5) of the Bhartiya Nyaya Sanhita, 2023, pending in the Court of learned Judicial Magistrate First Class, Bokaro.

Learned counsel appearing for the petitioner submits that the altercation took place on spur of the moment and there are general and omnibus allegation against eight persons of assaulting. He also submits that there is no specific allegation so far as the petitioner is concerned and the allegations of assault are there against the other co-accused person. He also submits that in the impugned order, the criminal antecedent has been disclosed against the petitioner. However, that case is against the Chhotu Yadav son of Osir Yadav of the State of Bihar, whereas the petitioner’s name is Chotu Kumar @ Chotu Yadav, son of Koushlendra Yadav, the resident of Sector-8 Bokaro.

opposed the prayer and submits that the allegations are there that upon the assault made by the petitioner, the informant has received injury and one another person Kumar Apurva. In view of that anticipatory bail may kindly be rejected.

Looking into the contents of the FIR, it transpires that there are general and omnibus allegation against eight persons of assault, there is no doubt that the injury has been received by the informant and another person, however, it is not clear that pursuant to whose blow, such injury has been received. It has been pointed out that the criminal antecedents as noted in the order of the learned Session Judge is against one Chotu Yadav, son of Osir Yadav and the petitioner's name is Chotu Kumar @ Chotu Yadav, son of Koshalendra Yadav residents of Sector-8, Bokaro, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate First Class, Bokaro in connection with Sector-4 P.S Case No. 83 of 2025, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.

This Anticipatory Bail Application is accordingly allowed and disposed of.
