06 /13.02.2026 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with Hatgamharia P.S. Case No.01 of 2024 for the alleged offences registered under Sections 420 and 120B of Indian Penal Code, Section 27(b)(ii) of Drugs and Cosmetic Act, 1940 and Section 21(c) of NDPS Act pending in the Court of learned Additional Sessions Judge-II, West Singhbhum, Chaibasa.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the name of the petitioner has come on the confessional statement of coaccused namely Md. Anis, who is the driver of Mahindra Bolero Pickup Van. He further submits that original name of the petitioner is Pradeep Kumar and in the body of the FIR his name is described

as Pradip Prasad. On these grounds, he submits that the petitioner

may kindly be granted anticipatory bail.

Learned counsel appearing for the State opposes the prayer and submits that Wincerex Cough Syrup having codeine in it which is schedule drug was being transported by Mahindra Bolero Pick-up Van hired by the petitioner and the petitioner was escorting the said pickup van. She submits that the syrup was also found in the commercial quantity. On these grounds, she submits that anticipatory bail of the petitioner may kindly be rejected.

5. Independent witnesses in paragraph Nos.5, 12, 13, 32 and 33 of the case diary have supported the prosecution case. The quantity was said to be commercial and the Wincerex Cough Syrup having codeine in it was being transported and further in paragraph Nos.20 and 21 of the original case diary it has come that the codeine phosphate coming within NDPS manufacturing drugs and found to be within commercial quantity.

6. In the attending facts and circumstances of this case, I am not inclined to grant anticipatory bail to the petitioner, hence, the prayer for anticipatory bail of the petitioner is hereby rejected.
