The petitioner is apprehending his arrest in connection with G.R. Case No.436/2024 arising out of Adityapur P.S. Case No.178/2024, registered for the offence under Sections 341, 323, 325, 302, 379, 506, 34 of the Indian Penal Code, pending in the Court of the learned C.J.M., Saraikella-Kharsawan.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case. He further submits that the petitioner has nothing to do with the said crime. He next submits that the petitioner has not assaulted upon the deceased.

Learned counsel appearing for the State opposed the prayer and submits that the petitioner has caught hold the deceased and pursuant to that, others have assaulted. He further submits that in paras 44, 110 and 111 of the case diary, witnesses have stated so. On these grounds, he submits that the prayer for anticipatory bail of the petitioner may kindly be rejected.

It transpires that the petitioner has caught hold the deceased and pursuant to that others have assaulted. The witnesses in paras 44, 110 and 111 of the case diary have supported the case of the informant. In the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioner and, as such, his prayer for anticipatory bail is, hereby, rejected.

Accordingly, this application is dismissed.
