The petitioner has been made accused in connection with Kunda P.S. Case No. 45 of 2025 registered for the offence punishable under Sections 103(1), 61(2)(a), 3(5) of the B.N.S. 2023.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed murder of Govind Pandey by assaulting on his head with Farsa (axe). It is further submitted that three accused persons have been admitted to regular bail while a 70 years old accused lady namely Tasar Devi has been given privilege of anticipatory bail. It is submitted that the allegation against the petitioner is false and 07 witnesses have been examined so far. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case and will not annoy or disturb the informant or witnesses of the case. It is lastly submitted that the petitioner has no criminal antecedents as mentioned in para 19 and the petitioner has been in custody since 16.03.2025 as mentioned in para-18 of the bail application. Hence, it is submitted that the petitioner be released on bail.

Learned Addl.P.P., on the other hand vehemently opposes the prayer for bail of the petitioner and submits that P.W.1 and 2 has categorically stated that it is the petitioner who assaulted Govind Pandey

on his head with Farsa (axe) resulting in his death and in view of overwhelming evidence that has come through deposition of P.W.1 and 2; there is every chance of the petitioner absconding and tampering with evidence, if released on bail. It is therefore, submitted that the petitioner ought not be released on bail.

Considering the serious nature of allegation of murder of Govind Pandey against the petitioner and the chance of the petitioner absconding and tampering with evidence, if released on bail, this Court is not inclined to admit the petitioner on bail.

Accordingly, the prayer for bail of the above-named petitioner is rejected .
