The petitioner has been made accused in connection with Rania P.S. Case No.27 of 2025 registered for the offences punishable under Section 103 (1), 238, 3 (5) of the B.N.S., 2023.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in furtherance of common intention with the co-accused persons, committed murder of Sonu Oraon and caused disappearance of the evidence of his murder. It is submitted that the allegation against the petitioner is false and general and omnibus in nature. It is further submitted that first a U.D. Case was registered in respect of the death of Sonu Oraon and during the course of enquiry in connection of that case, on the basis of the confessional statement of Shanika Munda and the written report submitted before the Assistant Sub Inspector of Police, this case has been registered and except the confessional statement of the Shanika Munda, there is no other material in the record to implicate the petitioner in this case. Drawing attention of this Court towards para-20 of the instant bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is further submitted that so far as three witnesses have been examined including the father of the deceased being the P.W.1 and the brother of the deceased being the P.W.2 but they

have not stated anything to implicate the petitioner in this case and they have identified the petitioner to the friend of Sonu Oraon. It is also submitted that the co-accused, with similar allegations, has already been admitted to bail by this Court vide order dated 16.03.2026 passed in B.A. No.12032 of 2025. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the informant and other witnesses of the case during the trial of the case. It is lastly submitted that the petitioner has been in custody since 21.08.2025 as has been mentioned in para-20 of the instant bail application. Hence it is submitted that the petitioner be released on bail.

Learned Addl. P.P. opposes the prayer for bail.

Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/(Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1^st Class, Khunti in connection with Rania P.S. Case No.27 of 2025 with the condition that he will co-operate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant and other witnesses of the case during the trial of the case.
