Heard the parties.

The petitioner has been made accused in connection with Sadar P.S. Case No.34 of 2026 (N) registered for the offences punishable under Sections 21/22 of the NDPS Act.

Learned counsel for the petitioner submits that the allegation against the petitioner is that from the petitioner and the co-accused person of 1.64 gm of brown sugar was recovered and the brown sugar recovered comes under small quantity. It is submitted that the allegation against the petitioner is false. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in para-11 of this bail application. It is lastly submitted that the petitioner has been in custody since 26.01.2026 as mentioned in the bail rejection order of the petitioner passed by the learned Special Judge, NDPS, Ranchi in Misc. Criminal Application No.268 of 2026. It is next submitted that the co-accused has been granted bail by the co-ordinate bench of this Court vide order dated 18.03.2026 in B.A. No.2139 of 2026. Hence it is submitted that the petitioner be released on bail.

Learned Spl.P.P. opposes the prayer for bail.

Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/(Rupees twenty five thousand) with two sureties of the like amount each

to the satisfaction of learned Judicial Commissioner-cum-Special Judge, NDPS, Ranchi in connection with Sadar P.S.
