Case No. 209 of 2025 registered under Sections 316(5) and 318(4) of the B.N.S. 2023, sought bail. Counsel submitted that the allegation was of cheating and criminal breach of trust over money allegedly not deposited with the informant, the alleged defalcated amount being Rs.3,06,262/-; that the case was falsely lodged for personal reasons with an unexplained delay of 25 days in lodging the F.I.R.; that the petitioner undertook to co-operate with the trial; and that he had been in custody since 04.06.2026 with no criminal antecedents. Learned Addl.P.P. opposed the prayer. Heard the parties.

The petitioner has been made accused in connection with Giridih (T)P.S. Case No. 209 of 2025, registered for the offence punishable under Section 316(5), 318(4) of the B.N.S. 2023.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed cheating and criminal breach of trust by not depositing the money collected by him with the informant. It is next submitted by the learned counsel for the petitioner that alleged defalcated amount is of Rs.3,06,262/-. It is further submitted that the due to personal reason this false case has been lodged and there is unexplained delay of 25 days in lodging the F.I.R. It is next submitted that the allegation against the petitioner is false. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is lastly submitted that the petitioner has been in custody since 04.06.2026 as mentioned in para-06 and has no criminal antecedents as mentioned in para-11 of the instant bail application. Hence it is submitted that the petitioner be released on bail.

Learned Addl.P.P. opposes the prayer for bail.

Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/(Rupees twenty five thousand) with two sureties of the like amount each

to the satisfaction of learned C.J.M., Giridih in connection with Giridih (T)P.S.
