Heard the parties.

The petitioner has been made accused in connection with Pipratand P.S. Case No. 14 of 2026 registered for the offence punishable under Sections 191(2), 191(3), 190, 115(2), 118(1), 117(2), 118(2) and 109 of the B.N.S., 2023.

Learned senior counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was a member of an unlawful assembly and in prosecution of common object of the assembly assaulted the members of informant party with pieces of wood and lathiDanda. It is next submitted that there is specific allegation against the coaccused namely Ishteyaque Miyan of being armed with an axe assaulted Abdul Warik @ Kariman from his back and Abdul Warik @ Kariman later on succumbed to the injuries during the course of treatment. It is further submitted that there is no allegation of use of any dangerous weapon by the petitioner. It is then submitted that the allegation against the petitioner is false. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case and will not annoy or disturb the informant or witnesses of the case. It is lastly submitted that the petitioner has been in custody since 09.04.2026 as mentioned in para-14 and has no criminal antecedent as mentioned in para 16 of the bail

application. though charge-sheet has already been submitted but none of the witnesses has been examined as yet. Hence, it is submitted that the petitioner be released on bail.

Learned Addl.P.P. opposes the prayer for bail.

Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/(Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1^st Class, Palamau at Daltonganj in connection with Pipratand P.S. Case No. 14 of 2026 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case in any manner during the trial of the case .
