This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of B.A. No.3424 of 2026 to its original file.

Learned counsel for the petitioners submits that B.A. No.3424 of 2026 was dismissed for non-compliance of the peremptory order of this Court dated 24.04.2026 whereby the petitioners were directed to file a supplementary affidavit annexing therewith the certified copy of the charge sheet. It is next submitted that the counsel for the petitioners informed the pairvikar of the petitioners to obtain the certified copy of the charge sheet and the pairvikar of the petitioners informed the same to the conducting counsel in the civil court but due to marriage function in the family of the conducting counsel in the civil court, the certified copy of the charge sheet could not be obtained within the stipulated time, resulting in dismissal of the said B.A. No.3424 of 2026. It is then submitted that the noncompliance of the peremptory order dated 24.04.2026, passed in the said B.A. No.3424 of 2026 was neither deliberate nor intentional. It is next submitted that the petitioners have very

good grounds to agitate in the said B.A. No.3424 of 2026 and unless B.A. No.3424 of 2026 is restored to its original file, the petitioners will be highly prejudiced. It is lastly submitted that the certified copy of the charge sheet has been obtained and has been filed by way of supplementary affidavit. Hence, it is submitted that B.A. No.3424 of 2026 be restored to its original file.

Considering the aforesaid submission of the learned counsel for the petitioners, B.A. No.3424 of 2026 is restored to its original file to the stage at which, it was before its dismissal.

List B.A. No.3424 of 2026 under the appropriate heading after a week before the appropriate Bench.
