03 /13.01.2026 Heard learned counsel appearing for the petitioners, learned counsel appearing for the State and learned counsel appearing for the Informant.

2. The petitioners are apprehending their arrest in connection with Nirsa P.S. Case No.460 of 2024, for the alleged offences registered under Section 103(1) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate 1^st Class, Dhanbad.

3. Learned counsel appearing for the petitioners submits that petitioners and deceased were friends. He further submits that

however charge-sheet has been submitted against co-accused Ranjit Dediya for the offence punishable under Section 108 and 3(5) of Bharatiya Nyaya Sanhita, 2023 and the case was initially registered under Section 103(1) Bharatiya Nyaya Sanhita, 2023 and investigation against the petitioners are kept pending. He then submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.18 of the petition. He next submits that one case was registered against other accused persons including one Jawed Shekh being Nirsa P.S. Case No.470 of 2024 wherein the allegations have been made of theft and that Jawed Shekh has stated that the deceased died due to electric shock as he was stealing cable wires from transformer in Benagoria. He also submits that now compromise has taken place between the petitioners and the informant and joint compromise petition has been filed contained in I.A.

4. Learned counsel appearing for the State submits that the allegations are there of going of the deceased along with these petitioners.

5. On query made by the Court what are the materials in the case diary, learned counsel appearing for the State submits that it has come in paragraph No.50 of the case diary one of the coaccused in his statement stated that due to fall from the electric pole the deceased has died.

6. Learned counsel appearing for the Informant submits that

compromise has been made between the petitioners and the informant.

In paragraph No.50 of the case diary, co-accused namely Ranjit Dediya has disclosed that in the course of theft of cable the deceased has fallen from the electric pole and due to that he has died and the petitioners and the informant has compromised the case. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1^st Class, Dhanbad in connection with Nirsa P.S. Case No.460 of 2024, subject to the conditions as laid down under

Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
