02/25.02.2026 Heard Mr. Anjani Kumar, learned counsel for the petitioner and Ms. Mohua Palit, learned APP for the State.

The present bail application has been filed on behalf of the petitioner namely, Raju Kumar for grant of regular bail who is in custody in connection with Gamharia P.S. Case No. 103 of 2025 instituted for the offences under Sections 109(1), 115(2), 126(2), 303(2)/3(5) of the B.N.S.

As per FIR, it is alleged that three (03) persons namely, Rakesh Kumar, Harsh Jha and Raju Kumar, the petitioners herein called the Informant near Kali Temple and when he arrived there, they started abusing and assaulted him by the empty bottles on his head due to which he sustained head injury and blood started oozing out.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence. It is submitted that general and omnibus allegations are made against all the accused persons including this petitioner. It is submitted

that similarly situated co-accused namely, Rakesh Kumar @ Rakesh Yadav @ Rakesh Kumar Yadav has already been granted bail by the Co-ordinate Bench (Hon’ble Mr. Justice Sanjay Kumar Dwivedi) of this Court vide order dated 22.01.2026 in B.A. No. 11583 of 2025 and the co-accused namely, Harsh Jha @ Harsh Kumar @ Harsh Kumar Jha has also been granted bail by the Co-ordinate Bench (Hon’ble Mr. Justice Rajesh Shankar) of this Court vide order dated 20.02.2026 in B.A. No. 172 of 2026 respectively. It is submitted that the petitioner is in jail custody since 04.10.2025 and hence, he may be enlarged on bail.

On the other hand, learned APP for the State has opposed the prayer of bail and submitted that the petitioner has also assaulted the Informant-injured on the day of his birthday and the Informant has sustained three (03) injuries and hence, the prayer for bail of the petitioner may be rejected. 6. Having heard the learned counsel for the parties and going through the records, it appears that there is general and omnibus allegations against all the accused persons including this petitioner for assaulted the Informant.

It appears that similarly situated co-accused namely, Rakesh Kumar @ Rakesh Yadav @ Rakesh Kumar Yadav has already been granted bail by the Co-ordinate Bench (Hon’ble Mr. Justice Sanjay Kumar Dwivedi) of this Court vide order dated 22.01.2026 in B.A. No. 11583 of 2025 and the co-accused namely, Harsh Jha @ Harsh Kumar @ Harsh Kumar Jha has also been granted bail by the Co-ordinate Bench (Hon’ble Mr. Justice Rajesh Shankar) of this Court vide order dated 20.02.2026 in B.A. No. 172 of 2026 respectively..

Considering the fact that two (02) similarly situated

co-accused namely, Rakesh Kumar @ Rakesh Yadav @ Rakesh Kumar Yadav and Harsh Jha @ Harsh Kumar @ Harsh Kumar Jha have already been granted bail by the Co-ordinate Bench, the petitioner namely, Raju Kumar is directed to be released on bail, on furnishing bail bonds of Rs.15,000/- (Rs. Fifteen Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Seraikella in connection with Gamharia P.S. Case No. 103 of 2025.

Thus, B.A. No. 523 of 2026 is allowed and stands disposed of.
