02/25.02.2026 The present bail application has been filed on behalf of the petitioner for grant of regular bail, who is in custody in connection with S.T. Case No. 705 of 2025 arising out of Hindpiri P.S. Case No.49 of 2025, instituted for the offences under Sections 310(4)/310(5) of B.N.S. and 25(1-B)a/26/35 of Arms Act, 1959 now pending in the Court of learned Shri Kuldeep, learned A.J.C.-XVIII, Ranchi.

2. As per F.I.R., Four persons, namely Md. Irfan, Md. Faizan Alam, Md. Meraj and Md. Ayan were apprehended by the Police near Chota Talab in the night of 23.07.2025 and one person fled away. It is alleged that a six round country made pistol and two live cartridges were recovered from the possession of co-accused Md. Irfan and one knife and one mobile phone were recovered from the possession of Md. Meraj, whereas one mobile phone was recovered from the possession of Md. Faizan Alam and they could not produce any document relating to the recovered articles. The apprehended person disclosed the name of the person who fled away as Md. Jahid @ Aliba, i.e. the petitioner.

3. Heard Mr. Faiz-ur-Rahman, learned counsel for the petitioner and Mrs. Vandana Bharti, learned A.P.P.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is submitted that the petitioner has been falsely implicated in this case. It is submitted that the name of the petitioner has been disclosed by the co-accused, namely Md. Irfan, Md. Faizan Alam, Md. Meraj and Md. Ayan, who were apprehended at the spot. It is submitted that nothing has been recovered from the possession of the petitioner. It is submitted that the petitioner has no criminal antecedent. It is submitted that the co-accused Faizan Alam @ Faiju and Md. Ayan have been granted regular bail by the Co-ordinate Bench (Mr. Justice Ambuj Nath, as His Lordship then was) vide order dated 18.12.2025 in B.A. No. 10773 of 2025. It is submitted that the petitioner has surrendered on 30.07.2025 and since then he is in jail and hence, the petitioner may be granted bail.

5. Learned A.P.P. has opposed the prayer for bail. It is submitted that petitioner was an accomplice of the four persons, namely Md. Irfan, Md. Faizan Alam, Md. Meraj and Md. Ayan, who were arrested by the Police from the place of occurrence, though the petitioner had fled away. It is submitted that the above named co-accused persons have named this petitioner and they were arrested with fire arms and knife, which was to be used for committing some crime. Hence, prayer for bail of the petitioner may be rejected.

6. Perused the F.I.R. and the records of this case and considered the submissions of both sides.

7. It appears that four persons, namely Md. Irfan, Md. Faizan Alam, Md. Meraj and Md. Ayan were apprehended from the spot by the police and the petitioner allegedly fled away and the name of the petitioner has been disclosed by the said co-accused persons.

8. It appears that there is no recovery from the petitioner and the petitioner is in custody since 30.07.2025.

9. Considering the custody of the petitioner and on the facts and in the circumstances of this case, petitioner, namely Jhid Ansari @ Md. Jahid @ Aliba is directed to be released on bail, on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen thousand) with two sureties of the like amount each in connection with S.T. Case No. 705 of 2025 arising out of Hindpiri P.S. Case No.49 of 2025, to the satisfaction of learned Shri Kuldeep, learned A.J.C.-XVIII, Ranchi/or his Successor Court, subject to the condition that one of the bailors must be own relative of the petitioner.

10. Thus, this B.A. No. 464 of 2026 is allowed.
