02/20.02.2026 The present bail application has been filed on behalf of the petitioner for grant of regular bail, who is in custody since 23.11.2025 in connection with Patan P.S. Case No. 104 of 2023 instituted for the offences under Section 394 of the Indian Penal Code.

It is alleged in FIR lodged by the Informant that on 25.06.2023, three unknown persons had committed robbery from the Informant and one boy by pointing pistol upon him and they have taken his bag in which Rs. 38,000/-of cash of LIC, ATM Card, PAN Card, Bank Passbook, Cheque Book receipts of the customers as well as other documents and miscreants fled away with TVS Jupiter Scooty.

Heard learned counsel for the petitioner and learned APP. 4. Learned counsel for the petitioner submitted that the petitioner is innocent and has not committed any offence. It is submitted that the name of the petitioner has transpired on the confession of Rahul Kumar. It is submitted that other co-accused Anand Kumar @ Anand Kumar Paswan, Saroj Kumar @ Suraj

and Rahul Kumar have already been granted bail on 07.12.2023 in B. A. No. 8776 of 2023, on 08.12.2023 in B. A. No. 8555 of 2023 and on 16.02.2024 in B. A. No. 10470 of 2023 respectively by the Co-ordinate Bench (Justice Amuj Nath as then His Lordship was) of this Court. It is submitted that the petitioner is in custody since 23.11.2025 and hence, he may be enlarged on bail

On the other hand, learned for the State has opposed the prayer of bail of the petitioner and has submitted that Scooty has been recovered from the possession of the petitioner and hence the prayer of bail of the petitioner may be rejected.

Having heard learned counsel for both the sides and from perusal of the records of this case, it appears that other co-accused Anand Kumar @ Anand Kumar Paswan, Saroj Kumar @ Suraj and Rahul Kumar have already been granted bail on 07.12.2023 in B. A. No. 8776 of 2023, on 08.12.2023 in B. A. No. 8555 of 2023 and on 16.02.2024 in B. A. No. 10470 of 2023 respectively by the Co-ordinate Bench (Justice Amuj Nath as then His Lordship was) of this Court. It appears that even the Co-ordinate Bench (Justice Amuj Nath as then His Lordship was) had granted bail to those persons also on the fact that they have not put on T.I. Parade.

It also transpires that the name of the petitioner has been transpired on the confession of Rahul Kumar and who has already been granted bail by the Co-ordinate Bench (Justice Amuj Nath as then His Lordship was) of this Court.

It further appears that the petitioner is in custody since 23.11.2025.

Considering the facts and circumstances of this case and the fact that petitioner is in custody since 23.11.2025, the petitioner- Guddu Prajapati @ Dharmendra Prajapati is directed to

be released on bail, on furnishing bail bonds of Rs.15,000/- with two sureties of the like amount each, to the satisfaction of Sri Nishikant, learned Judicial Magistrate, 1^st Class, Palamau or/his Successor Court in connection with Patan P.S. Case No. 104 of 2023.
