03 /14.07.2026 Heard the learned counsel appearing on behalf of the parties.

2. Learned counsel for the petitioner submits that the petitioner is in custody since 08.06.2023 in connection with Chaibasa Muffasil P.S. Case No.93 of 2023, corresponding to G.R. No.496 of 2023 (S.T. No.46 of 2024), for the offences registered under Sections 302/201/120B of the I.P.C. and section 3/4 of the Prevention of Witch (Daain) Practices Act, pending in the court of learned Additional Sessions Judge-II-cum-Special Judge POCSO Act, West Singhbhum at Chaibasa.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and it has come that the petitioner was in intoxicated condition and it has been alleged that the petitioner conspired with the co-accused to commit the murder of the deceased by slitting her throat. The learned counsel further submits that except confessional statement of the petitioner, there is nothing on record and the murder weapon has been recovered on the basis of confessional statement of the co-accused and the petitioner is in custody since 08.06.2023.

4. Learned counsel for the opposite party-State has opposed the prayer for bail, however, he could not point out other material from the case diary against the petitioner, except the confessional statement of the petitioner.

5. After hearing the learned counsel for the parties and considering the fact that the petitioner is in custody since 08.06.2023,

the petitioner above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 25,000/- (Rs. Twenty-five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge POCSO Act, West Singhbhum at Chaibasa, in connection with Chaibasa Muffasil P.S. Case No.93 of 2023, corresponding to G.R. No.496 of 2023 (S.T. No.46 of 2024) on the following conditions:

(i) One of the bailors would be the present pairvikar of the petitioner.

(ii) The other bailor should be his close relative.

¶17

(iii) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court.

(v) The petitioner shall fully co-operate with the proceedings before the learned court below.

6. However, the State is directed to ensure that the remaining witnesses are promptly produced before the concerned court.

7. Learned counsel for the State is directed to communicate a copy of this order to the Director, Prosecution as well as Superintendent of Police of the concerned district to ensure compliance.

8. Let this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through FAX/email.

9. The instant bail application is allowed with the aforesaid conditions.
