2. Nobody appears on behalf of the opposite party- State.
3. Learned counsel for the petitioner submits that the petitioner is in custody since 02.12.2025 in connection with S.T. No. 59 of 2026 arising out of Bengabad P.S. Case No. 181 of 2025, registered under Section 64(1) of Bharatiya Nyaya Sanhita, 2023, now pending in the court of learned Additional Sessions Judge-V, Giridih.
4. Learned counsel for the petitioner has further submitted that there is land dispute between the parties and the petitioner has been falsely implicated in this case. The petitioner is in custody since 02.12.2025.
5. The records of the case reveal that there is direct and specific allegation against the petitioner and the petitioner and her sister jointly caught hold of the petitioner and thereafter, the villagers arrived. It is alleged that the petitioner has committed rape upon the victim.
6. Considering the direct allegation made against the petitioner, this Court is not inclined to enlarge the petitioner on bail at this stage and hence, this bail application is rejected.
