03/ 15.07.2026 Heard learned counsel for the petitioners and learned A.P.P for the State.

The petitioners are apprehending their arrest in connection with Chhattarpur P.S. Case No. 150 of 2025, for the alleged offences registered under Sections 191(2), 191(3), 190, 126(2), 127(2), 115(2),117(2), 109(1), 74, 352, 351(2) of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj.

Learned counsel appearing for the petitioners submits that

the petitioners were constructing the house and the informant side has

tried to stop the work on the ground that the said land is of the Government. She next submits that there is free fight between the parties and both the sides have received injuries. She also submits that one injury is still reserved and the rest of the injuries have been found to be simple in nature. On these grounds, she submits that anticipatory bail may kindly be provided to the petitioners.

Learned A.P.P appearing for the State has opposed the prayer and submits that the allegations are there of making assault. On this ground, he submits that anticipatory bail may kindly be rejected.

On perusal of the FIR, it transpires that there are general and omnibus allegations against all the accused persons and it has been pointed out that there is a free fight, in which, both the sides have received injuries and one of the injury is kept reserved, however, rest injuries are simple in nature and further the petitioners are having no criminal antecedent and disclosure to that effect has been made in para12 of the petition.

Iin the attending facts and circumstances of the case, I am inclined to provide anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj, in connection with Chhattarpur P.S. Case No. 150 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
