The petitioner is apprehending his arrest in connection

with Complaint Case No.630 of 2026, for offence registered under section 47(a), 52(d) and 55 of Excise Act, pending in court of learned Chief Judicial Magistrate, Giridih.

Learned counsel for petitioner submits that the premises in question has been rent-out to one Krishna Saw by the petitioner and allegations are made of keeping spirit and liquor in the said house. He next submits that in identical situation, the co-accused person has been granted anticipatory bail by the learned Sessions Judge in ABP No.661 of 2026.

Learned State counsel opposes prayer and submits that the petitioner is said to be owner of the said premises and in view of that anticipatory bail may kindly be rejected.

one Krishna Saw wherefrom the alleged spirit and liquor have been recovered and one of the co-accused persons in identical situation has been granted anticipatory bail as aforesaid by the learned Sessions Judge, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Giridih, in connection with Complaint Case No.630 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
