The petitioner has moved for grant of bail in connection with Gumla P.S. Case No.370 of 2025, registered for offence under Sections 21(b), 22(b) & 29 of the N.D.P.S. Act, 1985, pending before the Court of learned Sessions Judge, Gumla.

Learned counsel for the petitioner submits as per prosecution case, the petitioner was apprehended with 8 grams of brown sugar containing in transparent plastic packet. The petitioner has no criminal antecedent of such type of offence and he is in custody since 12.11.2025. The quantity as alleged falls under intermediate quantity. The petitioner undertakes to cooperate in the trial of the case and abide by all terms and conditions which may be imposed. Hence, the petitioner may be admitted to bail.

Learned A.P.P. has opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and quantity of recovery of the brown sugar which false under intermediate quantity,

I am inclined to release the above-named petitioner, on bail.
