counsel for the State.

The petitioners are apprehending their arrest in connection with Itkhori P.S. Case No. 07 of 2022 registered under sections 147, 149, 323, 337, 338, 353, 504, 506, 120-B of the Indian Penal Code, 1860 pending in the Court of learned A.C.J.M, Chatra.

Learned counsel for the petitioners submits that allegations are made that hooliganism was made by a mob due to burying the dead body of a Muslim woman in a land of which was used as a graveyard while the other half was used by the majority community as a playground. He submits that there are general and omnibus allegation against the petitioners and several co-accused persons have been granted anticipatory bail in A.B.A. No. 7009 of 2024, A.B.A. No. 103 of 2025, A.B.A. No. 1182 of 2025 and A.B.A. No. 2843 of 2026. He next submits that petitioners have got no criminal antecedent which is disclosed in para 20 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that petitioners were member of unlawful assembly.

Considering that there are general and omnibus allegation against the petitioners and several co-accused persons have been granted anticipatory bail in the aforesaid A.B.As and the petitioners have no criminal antecedent which is disclosed in para 20 of the petition.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/(twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned A.C.J.M, Chatra, in connection with Itkhori P.S. Case No. 07 of 2022, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
