The petitioners are apprehending their arrest in connection with Garhwa P.S. Case No. 265 of 2026 registered under sections 191(2), 191(3), 190, 285, 115(2), 125(b), 109(2), 132, 221, 121(1), 324(4), 352, 351(3), 223 and 56 of BNS and under section 3 of Prevention of Damage to Public Property Act, 1984 pending in the Court of learned C.J.M, Garhwa. 3. Learned counsel for the petitioners submits that there was head on collision between tractor and Luna bike due to which two persons died for that agitation was going on and about 500 villagers assembled at the spot and they were demanding compensation and job. He next submits that there are general and omnibus allegation against all the accused persons including the petitioners. He next submits that the villagers present at the spot have taken the name of the petitioners and petitioners have got no criminal antecedent which is disclosed in para 5 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits

that petitioners were members of unlawful assembly.

Considering that for the alleged accident 500 villagers have assembled at the spot and they were agitating for the compensation and job. There are general and omnibus allegation against all the accused persons. The petitioners have got no criminal antecedent which is disclosed in para 5 of the petition.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/(twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned C.J.M, Garhwa, in connection with Garhwa P.S. Case No. 265 of 2026, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
