The petitioners are apprehending their arrest in connection with Herhang P.S. Case No. 07 of 2026, registered under sections 17, 18 and 29 of N.D.P.S. Act, pending in the Court of learned Special Judge, (N.D.P.S), Latehar.

Learned counsel for the petitioners submits that false allegation is made of cultivation of poppy plant in the forest area. He next submits that the said land is not belonging to the petitioners and petitioners have got no criminal antecedent which is disclosed in para 21 of the petition. He next submits that co-accused has been granted anticipatory bail in A.B.A. No.2460 of 2026. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there of cultivation of poppy plant in the forest area.

granted anticipatory bail in the aforesaid A.B.A, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners is directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Special Judge, (N.D.P.S), Latehar, in connection with Herhang P.S. Case No. 07 of 2026, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
