The petitioner is apprehending his arrest in connection with Deodanr PS Case No.03 of 2026, for offence registered under section 316(2), 318(4), 111 of BNS, 2023 and Section 66(C) and 66(D) of Information Technology Act, 2000, pending in court of learned S.D.J.M., Godda.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case arising out of cyber crime. She further submits that the petitioner has got no role. She fairly submits that the petitioner is having criminal antecedent and in that case the petitioner has been granted anticipatory bail and in view of that anticipatory bail to the petitioner may kindly be granted.

Learned State counsel opposes prayer and submits that the petitioner is having criminal antecedent of identical nature and anticipatory bail has already been granted in that case and thereafter the petitioner is also involved in another case, which is the subject matter of the present case and on these grounds anticipatory bail may kindly be rejected.

Considering that the case is arising out of cyber crime and the petitioner is said to be accomplice of 17 accused persons named in the FIR and the petitioner is also having criminal antecedent, and in the attending facts and circumstances of the present case, I am not inclined to grant anticipatory bail to petitioner. As such, prayer for anticipatory bail of the petitioner is hereby rejected and consequently, this anticipatory bail application is hereby dismissed.
