02/10.06.2026 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Ghatshila P.S. Case No. 24 of 2026, registered for the offence under Sections 76, 115(2), 117(2), 351(2), 109 and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Ghatshila.

Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case and there is land dispute between the parties. He further submits that the petitioners were doing the work of embankment on the land and pursuant to that the altercation started. He next submits that false allegation has been made of assault and even the alleged injury is said to be simple and that has come in the order of the learned Sessions Judge. He also submits that the petitioners are having no criminal antecedent as disclosed in para 14 of the petition.

Learned counsel appearing for the State opposes the prayer and submits that the allegation of assault are there.

Considering that the petitioners were doing the embankment work on the land in question and there is land dispute between the parties and even the alleged injury is said to be simple and that has come in the order of the learned Sessions Judge and the petitioners are having no

criminal antecedent as disclosed in para 14 of the petition, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Ghatshila, in connection with Ghatshila P.S. Case No. 24 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
