02 /08.05.2026 Heard learned counsel appearing for the petitioner as well as learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with Saraiyahat P.S. Case No.04 of 2026, for the alleged offences registered under Sections 115(2), 118(1), 117(2), 351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate 1^st Class, Dumka.

3. Learned counsel appearing for the petitioner submits that allegations are made that the informant was living at his grandfather’s house since childhood and there was dispute over the land matter. She further submits that the alleged occurrence is said to be dated 18.12.2025 wherein the FIR has been lodged on 05.01.2026. She then submits that allegation of injury is there, however, doctor has reserved the opinion on the point of injury No.1 and other injuries have been found to be simple. She next submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.11 of the petition.

4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of assault.

It transpires that the other co-accused persons have been granted anticipatory bail by learned Sessions Judge by the same impugned order, however, anticipatory bail application of the petitioner has been rejected as there was specific allegation against the petitioner and the alleged occurrence is said to be dated 18.12.2025 wherein the FIR has been lodged on 05.01.2026 and for one injury the opinion has been kept reserved by the doctor and other injuries have been found to be simple and the petitioner has got no criminal antecedent as disclosed in paragraph No.11 of the petition, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1^st Class, Dumka in connection with Saraiyahat P.S. Case No.04 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
