02/07.05.2026 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Bariatu P.S. Case No. 193 of 2025, registered for the offence under Sections 64, 69 and 351 of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1^st Class, XXI, Ranchi.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and petitioner and informant have come in contact in the year 2020 and thereafter, relationship was established. He also submits that even the marriage has been solemnized and that has been stated in para 11 of the complaint petition. He next submits that the petitioner is a Constable in the BSF and he is being posted at different places and he is not able to come as leave was not granted, complaint case was lodged which was converted into FIR.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of establishing the relationship on the pretext of marriage.

Looking into the contents of the complaint, it transpires that they have come into relationship in the year 2020 wherein complaint case has been registered on 23^rd June, 2025 and in the complaint case itself, it has been stated that they have met several times at different places. In the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within four weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, XXI, Ranchi, in connection with Bariatu P.S. Case No. 193 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
