03/ 07.05.2026 Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner is apprehending his arrest in connection with Ganga Nadi P.S. Case No. 10 of 2025, registered for the offence under Sections 25(1-b) (a), 26 and 35 of the Arms Act, pending in the court of learned Chief Judicial Magistrate, Sahibganj.

Learned counsel appearing for the petitioner submits that from the possession of two apprehended co-accused, the arms and five live cartridges were recovered. He next submits that the name of the petitioner has come on the basis of confessional statement and further the petitioner is a farmer and he is having no criminal antecedent which is disclosed in para-18 of the petition. He further submits that in the similar circumstance, the other co-accused has already been granted anticipatory bail in A.B.A. No. 961 of 2026 by this court.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the name of the petitioner has come on the basis of confessional statement.

Considering that the name of the petitioner has come on the basis of confessional statement and further the petitioner is having no

criminal antecedent which is disclosed in para-18 of the petition and in the similar circumstance, the other co-accused has already been granted anticipatory bail in the aforementioned A.B.A. and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sahibganj, in connection with Ganga Nadi P.S. Case No. 10 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023
