The petitioner is apprehending his arrest in connection with Complaint Case No.4102/2023, registered for the offence under Section 47(a) of Excise Act, pending in the Court of the learned C.J.M., Dhanbad.

Learned counsel appearing for the petitioner submits that false allegation is made against the petitioner of keeping foreign liquor in the house. He next submits that even in the seizure list, all the police officials have signed and no independent witness has signed on seizure list. He also submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 7 of this application. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner.

Learned counsel appearing for the State opposed the prayer and submits that foreign liquor has been recovered from the house of the petitioner.

Considering that in the seizure list only the police officials have signed and there is no independent witness and it has been pointed out that the petitioner has got no criminal antecedent, as disclosed in paragraph 7 of this

application and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Dhanbad in connection with Complaint Case No.4102 of 2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
