1. Heard learned counsel appearing for the petitioner and learned counsel appearing for the State as well as Mr. Rajesh Kumar, learned counsel appearing for the informant.

2. The petitioner is apprehending his arrest in connection with R.I.T. P.S. Case No. 64 of 2025, registered for the offence under Sections 406/ 420/ 467/ 468/ 471/ 506/ 120B of the Indian Penal Code, pending in the Court of the learned S.D.J.M, Seraikella.

3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case. He next submits that the grandfather of the informant, namely Keshar Gour by virtue of Sale Deed No.1396 dated 09.06.1964 had transferred land pertaining to Khata No.48, Plot No.618 measuring 31 decimals, Plot No. 621 measuring 54 decimals, Total Area 85 Decimals of Thana No. 131 Mouza Asangi to one Ram Chandra Sharma. Kumar Mahapatra, who happens to be son of late Ram Chandra Sharma constituted and appointed the petitioner his constituted attorney and executed a general power of attorney No.443 dated 22.12.2022 in his favour in respect of land pertaining to Khata No. 48, plot No. 618 measuring 31 decimals, Plot No. 621 measuring 54 decimals, Total Area 85 decimals of Thana No. 131, Mouza Asangi. He submits that based on the said power of attorney, the petitioner has transferred such a land and the allegations are made that the mother of the informant has constituted a power of attorney to another person for the same land in question.

Learned counsel appearing for the State and learned counsel appearing for the informant, opposed the prayer and they submit that the allegations are made that the mother of the informant has constituted a power of attorney to another person for the same land in question. On these grounds they submit that the prayer for bail of the petitioner may be rejected.

Annexure-2 is a correction slip and rent receipt which prima facie suggests that the land in question was recorded in the name of Keshar Gour and Keshar Gour has transferred the said land to Ram Chandra Sharma. Ram Chandra Sharma died and thereafter, his son Satish Kumar Mahapatra has made the power of attorney in favour of the petitioner and the said Satish Kumar Mahapatra is also made accused no.8 in the present case.

6. Prima facie, it transpires that the dispute is civil in nature for that a complaint case was filed and subsequently FIR has been lodged, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within two weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned S.D.J.M, Seraikella, in connection with R.I.T. P.S. Case No. 64 of 2025, subject to the conditions as laid down under section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
