02/20.01.2026 Heard learned senior counsel appearing for the petitioners and learned counsel appearing for the State.

The petitioners are apprehending their arrest in connection with Ahilyapur P.S. Case No.38/2023, corresponding to Cyber Case No.51/2023, registered for the offence under Sections 411, 413, 414, 419, 420, 467, 468, 471, 120B/34 of the Indian Penal Code and Sections 66(B), 66(C), 66(D) of the Information Technology Act, pending in the Court of the learned Additional Sessions Judge-II cum Special Judge (Cyber Crime), Giridih.

Learned senior counsel appearing for the petitioners submits that the petitioners had earlier moved before this Court in A.B.A. No.4735 of 2024, which was dismissed as withdrawn by a Coordinate Bench of this Court, vide order dated 23.04.2025. He further submits that petitioner no.1 had again moved before this Court in A.B.A.No.5508 of 2025, which was dismissed as withdrawn by this Court with liberty to the petitioner to move before the learned Sessions Judge, vide order dated 18.09.2025. He then submits that petitioner no.2 had again moved before this Court in A.B.A. Filing No.20318

of 2025, which was dismissed as withdrawn by this Court with liberty to the petitioner to move before the learned Court, vide order dated 26.09.2025. He next submits that there is changed circumstance and in view of the fact that co-accused has been granted anticipatory bail by a Coordinate Bench of this Court in A.B.A. No.4937 of 2024, vide order dated 27.03.2025. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioners.

Learned counsel appearing for the State opposed the prayer and submits that there is no changed circumstance and that ground was already there when the petitioners had withdrawn earlier filed anticipatory bail applications.

In view of the above, it transpires that the petitioners had thrice moved before this Court for anticipatory bail and the said anticipatory bail applications were dismissed as withdrawn. The ground has been taken that the co-accused has been granted anticipatory bail in A.B.A. No.4937 of 2024, vide order dated 27.03.2025. The same ground was available to the petitioners at the time while the petitioners had withdrawn anticipatory bail applications thrice.

In that view of the matter, there is no changed circumstance to entertain this anticipatory bail application and, as such, the prayer for anticipatory bail of the petitioners is, hereby, rejected.

Accordingly, this application is dismissed.
