Heard the parties.

The petitioner has been made accused in connection with Chandankiyari P.S. Case No.195 of 2024 corresponding to G.R. No.798 of 2025 (S.T. Case No.251 of 2025) registered for the offences punishable under Section 303 (2), 324 (4), 324 (5), 111, 112 (2), 61 (2), 3 (5) of the B.N.S., 2023 and Section 3/6 of the Prevention of Damage to Public Property Act, 1984.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in cutting ATM Machine of H.D.F.C. Bank at Chandankiyari Bazar and looted Rs.29,56,000/-. It is submitted that the allegation against the petitioner is false. It is further submitted that the petitioner has been implicated in this case only on the basis of confessional statement of co-accused Manohar Kumar Sahani who has since been admitted to bail by the learned Judicial Magistrate concerned. It is next submitted that there is specific allegation against the co-accused Ram Kumar son of Jagdish Nonia of breaking the lock of the ATM Machine and the only allegation against the petitioner is that his motorcycle was allegedly used by the co-accused persons in commission of the offence. It is then submitted that the petitioner undertakes that he will co-operate with

the trial of the case and that he will not annoy or disturb the informant and other witnesses of the case during the trial of the case. It is lastly submitted that the petitioner has been in custody since 19.04.2025 as has been mentioned in para-14 of the instant bail application. Hence it is submitted that the petitioner be released on bail.

Learned Addl. P.P. opposes the prayer for bail.
