The instant Writ Petition has been filed for direction upon the Respondent No.2 [Sub Divisional Magistrate cum Prabhari Officer Jugsalai Nagar Parishad at Dhalbhum] to dispose of the application filed by the petitioner under Section 21(4) of the Jharkhand Building and Apartment Act, 2011.

Petitioner claims from the Respondent Nos.3 and 4 Flat No.6, area 1500 sq. feet in the Jugsalai Project, in pursuant to the agreement entered on 15.12.2012. A sum of Rs.20,50,000/- has already been paid.

On being aggrieved by non-registration in favour of the petitioner, representation was filed under the provisions herein-before mentioned which is still pending before the Respondent No.2.

Learned counsel for the State seeks time to file counter-affidavit.

From the averment of the Writ Petition, it is apparent that a representation was filed as per the statutory provision which is pending before the Respondent No.2. Unless and until, the said representation is decided, no purpose will be served by filing counter-affidavit.
