The petitioners are the members of the Schedule tribal community and are aggrieved by the entry of the name of the private respondents nos. 5 to 13 in Register-II in place of the petitioners. For rectification of Register-II, representation has been submitted by the petitioners before the Deputy Commissioner, Bokaro which is still pending.

It is submitted by learned counsel for the petitioners that the land appertaining to Khata No. 2, Plot Nos. 142, 196 and 178, total area of 7.15 acres was recorded in the name of the ancestors of the petitioners namely Churka Manjhi on the continuous Khatiyan. The private

respondents by resorting to forgery and in collusion with the revenue authorities procured rent receipts on the basis of Sada Hukumnama. A report in this regard was called for by the Sub Divisional Officer, Bermo at Tenughat from the Circle Officer, Nawadih Block. The Circle Officer in his letter No. 406 dated 30.07.2024 (Annexure-3) has reported that as per Khatiyan, the land of 7.15 acres was entered in the name of the petitioners’ ancestors but the respondents on the basis of Sada Hukumnama had got entered in Register-II on 10.11.1993. It has also been stated in the said letter that Jamabandi was opened without any formal order by the competent authority. It is submitted that despite these materials, the representation for correction in Register-II is still pending and no final order has been passed.

Under the circumstance, the petitioners are directed to file fresh representation afresh before the Deputy Commissioner, Bokaro (Respondent no. 2) for correction in the entries made in Register-II, which will be disposed of by the Deputy Commissioner, Bokaro within a period of four weeks from the date of filing of the said representation.

Writ petition stands disposed of.
