Case No. 14/2025 pending before the Judicial Magistrate, 1st Class, Koderma, for offences registered under Sections 338, 336(3), 318(4) & 61(2) of the B.N.S., 2023, Section 66 of the I.T. Heard the parties.

The petitioner has been made accused in connection with Markacho P.S. Case No. 14/2025, for the offences registered under Sections 338, 336(3), 318(4) & 61(2) of the B.N.S., 2023 and Section 66 of the I.T. Act and Section of 10 of Jharkhand Conduct of Examination Act, pending in the Court of Ms. Namita Minz, learned Judicial Magistrate, 1^st Class, Koderma.

On 19.02.2025, it transpired that question paper of subject Hindi and Science was leaked through Telegram mobile app via channelPawan Smart Study. During the course of investigation, it transpired that the petitioner and co-accused persons were engaged as labourer for unloading the packets of question paper from truck, which was taken to the examination centers. The petitioner was apprehended and he confessed his guilt.

Learned counsel for the petitioner has submitted that there is no material available against this petitioner on record. It was further submitted that co-accused has been granted bail by the learned Court below itself. It was also submitted that that petitioner is in custody since 25.02.2025.

Learned Special P.P. after going through the case diary has submitted that apart from confession of this petitioner, there is no material available against this petitioner on record.

In view of the aforesaid facts, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed

to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Ms. Namita Minz, learned Judicial Magistrate, 1^st Class, Koderma in connection with Markacho P.S. Case No. 14/2025.
